Woman who returned adopted Russian boy faces suit (AP)

SHELBYVILLE, Tenn. ? A March trial has been scheduled in a child support lawsuit against an American woman who sent her adopted son back to Russia alone on a plane with a note saying she didn't want to be his mother anymore.

The adoptive mother, Torry Hansen, is being sued by her adoption agency, World Association for Children and Parents, for child support. Hansen was living in Shelbyville in April 2010 when she sent the boy, then 7, back to Moscow with a note stating he had psychological problems.

Trial is scheduled March 27 in Shelbyville's circuit court, Judge F. Lee Russell's office said.

Hansen has not been criminally charged. The incident drew international attention and prompted new adoption agreements between the U.S. and Russia.

All-white blackbird photographed

This unusual blackbird is attracting bird watchers to a Nottinghamshire country park.

The bird is leucistic, which is a genetic mutation that prevents pigments from being deposited normally in its feathers.

It has been residing for the last four years in the woodland of Rufford Abbey Country Park.

Each year, observers say, it has steadily shed its black feathers for white feathers.

Park rangers took this picture of the blackbird - which is now completely white with no visible pigmented feathers - in the summer of 2011.

Leucistic birds are often very vulnerable to predators, because of their bright white plumage. So the park's managers are urging birdwatchers to keep an eye out for this unusual blackbird.

Site manager John Clegg said: "This bird has been steadily turning whiter over the years and last summer it was completely white.

"It has become quite a character at the park in recent years.

"It tends to appear in the warmer months and we have not seen it for a few months but hope it will return here soon."

Most leucistic birds have some spots or patches of colouration in their feathers from other pigments, so this is a particularly unusual specimen.

High court: warrant needed for GPS tracking

(AP) ? The Supreme Court ruled unanimously Monday that police must get a search warrant before using GPS technology to track criminal suspects.

The decision was a defeat for the government and police agencies, and it raises the possibility of serious complications for law enforcement nationwide, which increasingly relies on high tech surveillance of suspects, including the use of various types of GPS technology.

A GPS device installed by police on Washington, D.C., nightclub owner Antoine Jones' Jeep helped them link him to a suburban house used to stash money and drugs. He was sentenced to life in prison before the appeals court overturned the conviction.

Associate Justice Antonin Scalia said that the government's installation of a GPS device, and its use to monitor the vehicle's movements, constitutes a search, meaning that a warrant is required.

"By attaching the device to the Jeep" that Jones was using, "officers encroached on a protected area," Scalia wrote. He concluded that the installation of the device on the vehicle without a warrant was a trespass and therefore an illegal search.

All nine justices agreed that the GPS monitoring on the Jeep violated the Fourth Amendment's protection against unreasonable search and seizure, a decision the American Civil Liberties Union said was an "important victory for privacy."

Washington lawyer Andy Pincus called the decision "a landmark ruling in applying the Fourth Amendment's protections to advances in surveillance technology." Pincus has argued 22 cases before the Supreme Court and filed a brief in the current case on behalf of the Center for Democracy and Technology, a civil liberties group with expertise in law, technology, and policy.

Scalia wrote the main opinion of three in the case. He was joined by Chief Justice John Roberts and Justices Anthony Kennedy, Clarence Thomas and Sonia Sotomayor.

Sotomayor also wrote one of the two concurring opinions that agreed with the outcome in the Jones case for different reasons.

Justice Samuel Alito wrote, in the other concurring opinion, that the trespass was not as important as the suspect's expectation of privacy. Police monitored the Jeep's movements over the course of four weeks after attaching the GPS device.

"The use of longer term GPS monitoring in investigations of most offenses impinges on expectations of privacy," Alito wrote in an opinion joined by Justices Ruth Bader Ginsburg, Stephen Breyer and Elena Kagan. Sotomayor in her concurring opinion specifically said she agreed with Alito on this conclusion.

Alito added, "We need not identify with precision the point at which the tracking of this vehicle became a search, for the line was surely crossed before the four-week mark."

Regarding the issue of duration, Scalia wrote that "we may have to grapple" with those issues in the future, "but there is no reason for rushing forward to resolve them here."

Alito also said the court should address how expectations of privacy affect whether warrants are required for remote surveillance using electronic methods that do not require the police to install equipment, such as GPS tracking of mobile telephones. Alito noted, for example, that more than 322 million cellphones have installed equipment that allows wireless carriers to track the phone's location.

"If long-term monitoring can be accomplished without committing a technical trespass ? suppose for example, that the federal government required or persuaded auto manufacturers to include a GPS tracking device in every car ? the court's theory would provide no protection," Alito said.

Sotomayor agreed. "It may be necessary to reconsider the premise that an individual has no reasonable expectation of privacy in information voluntarily disclosed to their parties," she said.

A federal appeals court in Washington had overturned Jones's drug conspiracy conviction because police did not have a warrant when they installed a GPS device on his vehicle and then tracked his movements for a month. The Supreme Court agreed with the appeals court.

The case is U.S. v. Jones, 10-1259.

State of Union: Obama to take on economic anxiety (AP)

WASHINGTON ? Eager to command center stage in a year dominated by Republican infighting, President Barack Obama is polishing a State of the Union address that will go to the heart of Americans' economic anxiety and try to sway voters to give him four more years. He will speak Tuesday to a nation worried about daily struggles and unhappy with his handling of the economy.

Obama's 9 p.m. EST address before a politically divided Congress will be built around ideas meant to appeal to a squeezed middle class. He is expected to urge higher taxes on the wealthy, propose ways to make college more affordable, offer new steps to tackle a debilitating housing crisis and try to help U.S. manufacturers expand hiring.

Designed as a way for a president to update the nation and recommend ideas to Congress, the State of the Union address has become more than that, especially during that one window when the address falls during the re-election year of an incumbent. It is televised theater ? and Obama's biggest, best chance so far to offer a vision for a second term.

He will frame the campaign to come as a fight for fairness for those who are struggling to keep a job, a home or college savings and losing faith in how the county works.

The speech will be principally about the economy, featuring the themes of manufacturing, clean energy, education and American values.

No matter whom Obama faces in November, the election is likely to be driven by the economy, and determined by which candidate wins voters' trust on how to fix it. More people than not disapprove of Obama's handling of the economy.

The overarching political goal is to give voters a contrast between his vision of a government that tries to level the playing field and those office-seekers who, in his view, would leave people on their own. Without naming them, Obama has in his sights those after his job, including Republicans Mitt Romney and Newt Gingrich.

The presidential campaign sets an unmistakable context for the speech, right down to the nation's income gap between haves and have-nots. Obama will speak on a few hours after Romney, a former governor and businessman whose wealth is the hundreds of millions of dollars, will release tax records for 2010 and 2011.

The lines of argument between Obama and his rivals are already stark, with America's economic insecurity and the role of government at the center.

The president has offered signals about his speech, telling campaign supporters he wants an economy "that works for everyone, not just a wealthy few." Gingrich, on the other hand, calls Obama "the most effective food stamp president in history." Romney says Obama "wants to turn America into a European-style entitlement society."

Obama's tone will be highly scrutinized given that his address falls smack in the middle of a fierce and frenzied Republican presidential nomination process. He will make bipartisan overtures to lawmakers but will leave little doubt he will act without opponents when it's necessary and possible, an approach his aides say has let him stay on offense.

The public is more concerned about domestic troubles over foreign policy than at other any time in the past 15 years, according to a new survey by the Pew Research Center. Some 81 percent want Obama to focus his speech on domestic affairs, not foreign ones; just five years ago, the view was evenly split.

On the day before Obama's speech, his campaign released a short Web ad showing monthly job losses during the end of the Bush administration and the beginning of the Obama administration, with positive job growth for nearly two Obama years. Republicans assail him as failing to achieve a lot more.

House Speaker John Boehner, responding to reports of Obama's speech themes, said it was a rehash of unhelpful policies. "It's pathetic," he said.

Obama will offer economic proposals for this year, despite long odds against getting the help he would need from Republicans.

Presidential spokesman Jay Carney said Monday that Obama is not conceding the next 10 months to "campaigning alone" when people need economic help. On the goals of helping people get a fair shot, Carney said: "There's ample room within those boundaries for bipartisan cooperation and for getting this done."

For three days following his speech, Obama will promote his ideas in five states key to his re-election bid: Iowa, Arizona, Nevada, Colorado and Michigan. He speaks on Friday about college affordability at the University of Michigan.

Meanwhile, the Republican race is suddenly a race again, given Gingrich's resounding win in the South Carolina primary over the weekend. Romney, who appeared the strong front-runner coming into that primary, is now focusing on Gingrich more than Obama as the GOP contest unfolds in Florida.

Vice President Joe Biden, in an interview with radio host Ryan Seacrest, said Monday there is no ideological difference between any of the Republicans seeking to challenge Obama. He said the campaign will offer the clearest choice in which direction to take the country since the era of the Great Depression.

Polling shows Americans are divided about Obama's overall job approval but unsatisfied with his handling of the economy.

Small Business Lending Rises At Chase, Citi

(Reuters) - Global lending giants Chase (JPM.N) and Citi (C.N) said they substantially increased loans to U.S. small businesses last year, both exceeding previous commitments.

Chase said its small business loans rose to $17 billion in 2011, up 52 percent from 2010.

Citi said it lent $7.9 billion to small companies last year, an increase of more than 30 percent from the prior year and exceeding its previous commitment of $7 billion. Since the start of the economic downturn in late 2008, many small businesses have been struggling to get loans, lines of credit and other financing.

But a monthly poll of small business sentiment released Jan. 10 by the National Federation of Independent Business, a trade group, said small businesses' access to credit ranked at the bottom of respondents' concerns, with only 4 percent of owners reporting financing as their primary business problem.

Chase, which says it leads in U.S. Small Business Administration loans by volume, provided nearly 400,000 new loans and lines to small companies last year. For the past three years, the company exceeded annual small business lending commitments.

Last fall it pledged to maintain elevated lending volumes through at least 2013.

"Since 2009, we have provided more than $35 billion in working capital, term loans for expansion, commercial mortgages, lines of credit and business credit cards to small businesses," said Scott Geller, Chase's CEO of business banking, in a statement accompanying the lending figures Jan. 19.

In September 2011, Citi committed to lending $24 billion to small businesses over the course of three years. Its progressive increases call for lending to reach $9 billion annually in 2013.

"We made it easier for customers to apply for credit by offering less paperwork and an improved customer experience," said Raj Seshadri, Citi's head of U.S. Small Business, in the company's prepared statement, also released Jan. 19.

"Over the last year we tripled originations and increased credit application approvals substantially."

Most Americans Wasting Their Votes in 2012 Election (ContributorNetwork)

COMMENTARY | The ability for a Republican candidate to beat President Barack Obama in the 2012 election topped the concerns of voters in the South Carolina primary, according to ABC News. As a political scientist, I have to laugh at the idea of voting for someone because you believe he or she is more likely to win than someone else. There are holes in the logic.

First off, if you are simply voting for someone who you believe could win, are you really living up to your responsibility as a voter? Our true responsibility as voters is to vote for the candidate we believe represents our ideas and ideals the best. We hear the phrase, "wasting a vote" and equate it to voting for someone who we know is going to lose. In actuality, we waste our vote if we do not vote for the person we support for the 2012 election.

If we vote for the "perceived winner" of the 2012 election, we are not sending a message to the candidates. Take Ron Paul, for example. The stronger numbers he is putting up this year is sending a message to Congress and to the future president about how more Americans are interested in having conversations about the scope of our rights and responsibilities under the Constitution. A message is being sent that people want to review what politicians are doing against the Constitution.

Right now, it is impossible to predict a Republican candidate as someone who would beat President Obama. Politics are like football when you consider how any candidate has a chance of beating another candidate on any given day. Torrential rains could happen one day and keep voters away. The ones who are most passionate about their candidate would be more likely to head to the polls. Many of us have had times in which we did not vote because we believed our candidate was the sure winner.

If you vote for someone in the 2012 election because he appears to be the winner, you are wasting your vote and not sending a message up the line. You are not living up to your responsibility as a voter. Vote for the candidate you believe speaks the most to you, and not simply the country at large. You were given a right, so use it to the full potential.

Alexander Adler: The Weight of Neshat

Shirin Neshat's latest series of photographs presented along with a video installation at Gladstone Gallery perpetuate her study of the underlying conditions of power within socio-cultural structures in the Middle East. Born in Qazvin, Iran before immigrating to the United States in 1974, Neshat's artistic practice has focused on the plight of women in oppressive, Muslim societies. Addressing the Arab Spring and the momentum of these uprisings, Neshat turned to historical and contemporary sources to create technically beautiful and richly provocative photographic portraits.

ROCHESTER, N.Y. (AP) ? Eastman Kodak Co. has a little over a year to reshape its money-losing businesses and deliver a get-out-of-bankruptcy plan.

Girded by a $950 million financing deal with Citigroup Inc., the photography pioneer aims to keep operating normally during bankruptcy while it peddles a trove of digital-imaging patents.

After years of mammoth cost-cutting and turnaround efforts, Kodak ran short of cash and sought protection from its creditors Thursday. It is required under its bankruptcy financing terms to produce a reorganization plan by Feb. 15, 2013.

U.S. Bankruptcy Judge Allan Gropper in New York gave Kodak permission to borrow an initial $650 million from Citigroup.

He also set a June 30 deadline for Kodak to seek his approval of bidding procedures for the sale of 1,100 patents that analysts estimate could fetch at least $2 billion. No buyers have emerged since Kodak started shopping them around in July.

Through negotiations and lawsuits, Kodak has already collected $1.9 billion in patent licensing fees and royalties since 2008. Last week, it intensified efforts to defend its intellectual property by filing patent-infringement lawsuits against Apple Inc., HTC Corp., Samsung Electronics and Fujifilm Corp.

Kodak is also pursuing another high-stakes dispute before the U.S. International Trade Commission in Washington, D.C., against Apple and BlackBerry maker Research in Motion Ltd. over image-preview technology it patented in 2002.

Kodak has said it hopes to garner $1 billion from the two-year-old claim. But the commission, a U.S. arbiter for trade disputes, recently put off its decision until September.

Founded by George Eastman in 1880, Kodak turned photography into a mass commodity at the dawn of the 20th century and was known all over the world for its Brownie and Instamatic cameras and its yellow-and-red film boxes. It was brought down first by Japanese competition and then an inability to keep pace with the shift from film to digital technology.

"They're a company that knows more about imaging than anyone else in the world," said Robert Burley, a photography professor at Ryerson University in Toronto. "But I think they lost their ability in their corporate structure to turn those innovations into real-world applications and get them on the market fast.

"There were just too many fronts to deal with, too many battles all at the same time."

In its Chapter 11 filing, Kodak said its nearly decade-long overhaul has been undermined since 2008 by a sluggish economy and high restructuring costs. Its payroll has plunged below 19,000 from 70,000 in 2002, and it hasn't had a profitable year since 2007.

"At the same time as we have created our digital business, we have also already effectively exited certain traditional operations, closing 13 manufacturing plants and 130 processing labs, and reducing our workforce by 47,000 since 2003," CEO Antonio Perez said.

"Now we must complete the transformation by further addressing our cost structure and effectively monetizing non-core (intellectual-property) assets," Perez said in a statement.

Kodak's stock edged up to 32 cents in over-the-counter trading Friday afternoon. The bankruptcy filing prompted the New York Stock Exchange to delist the securities.

SAN FRANCISCO ? Yahoo co-founder Jerry Yang is leaving the struggling Internet company, as it tries to revive its revenue growth and win over disgruntled shareholders under a new leader.

The departure, announced Tuesday, punctuates the end of an era at Yahoo, a tarnished Internet icon that has spent much of the last decade scrambling to catch up to Internet search leader Google Inc. ? a company that got early encouragement and advice from Yang. It comes just two weeks after Yahoo Inc. hired former PayPal executive Scott Thompson as its CEO.

Thompson is the fourth CEO in less than five years to try to turn around Yahoo. It's a daunting assignment that Yang was unable to pull off during his own tumultuous 18-month reign as the company's CEO in 2007 and 2008.

Yang, 43, endorsed Thompson in his resignation from Yahoo's board of directors. He had been on Yahoo's board since the company's 1995 inception.

"My time at Yahoo, from its founding to the present, has encompassed some of the most exciting and rewarding experiences of my life," Yang wrote in a letter to Yahoo Chairman Roy Bostock. "However, the time has come for me to pursue other interests outside of Yahoo."

The letter didn't say what Yang plans to do next. He doesn't need to work, thanks to the fortune he has amassed since he began working on Yahoo in a trailer at Stanford University with fellow graduate student David Filo. Yang is worth about $1.1 billion, according to Forbes magazine's latest estimates.

Yang is also stepping down from the boards of China's Alibaba Group and Yahoo Japan. Yahoo is negotiating to sell its stakes in both of the Asian companies as part of its efforts to placate investors. The deal could be worth as much as $17 billion, but it still faces a series of potential stumbling blocks.

Besides surrendering the board seats, Yang is giving up his position as "Chief Yahoo," an honorary title he held as he mingled among workers, while keeping tabs on various company projects.

Thompson could have an easier time overhauling Yahoo without Yang looking over his shoulder and possibly second guessing his decisions, said BGC Financial analyst Colin Gillis.

"This has the fingerprints of frustration on it," Gillis said. "It's one of those situations where it looks like (Yang) is losing the battle to control the company's direction and now he is saying, `That's it, I'm out.'"

Although a popular figure among Yahoo employees, Yang had alienated the company's shareholders by turning down a chance to sell Yahoo in its entirety to Microsoft Corp. for $47.5 billion, or $33 per share, in May 2008. Yahoo shares haven't topped $20 for more than three years. The stock gained 44 cents to $15.87 in extended trading after Yang's decision was announced.

The slump in Yahoo's stock has diminished Yang's wealth. He still owns a 3.6 percent stake in the company.

Yang conceivably could leverage those holdings to attempt to buy Yahoo's U.S. business after the Asian investments are sold. That is, if he can line up additional financing, Macquarie Securities analyst Ben Schachter wrote in a research note late Tuesday. Several buyout firms have already expressed interest in buying a substantial stake in Yahoo, spurring speculation that Yang might work with them to acquire a controlling interest in what remains of the company if the Asian assets are sold.

When he announced Thompson's hiring earlier this month, Bostock stressed that Yahoo intended to remain an independent, publicly traded company.

Yang had been someone more interested in preserving the company than he created than dismantling parts of its to boost the stock price, analysts said. "Investors tend to want to keep trying to fix the company than carve it apart," Gillis said.

Now that he is out of the way, investors are likely to conclude the sale of the Asian investments will eventually be completed, Schachter wrote.

Midfielder Emre Belozoglu and other Fenerbahce players carried his coffin, draped in Turkish and Fenerbahce flags, to the pitch before the crowd observed a minute of silence in his memory.

Kucukandonyadis was the captain of Turkey's national team, making 46 appearances for his country. His club career included Fenerbahce, where he scored 423 goals in 615 games.

Fenerbahce fans who had no doubt that Lefter could turn every opportunity into a goal, often shouted: "give it (the ball) to Lefter, let him write it (the score) down in the book," Fenerbahce said on its website.

Born in 1925 in Istanbul to a fisherman father from Turkey's minority Greek community, Kucukandonyadis was the first player from Turkey to play abroad. He transferred to Italy's Fiorentina in 1951 followed by a spell with Nice in France.

After his retirement in 1966, Kucukandonyadis coached clubs in Greece, South Africa and Turkey.

Kucukandonyadis was buried in the island of Buyukada near Istanbul, where he was born.
